ERISA "Wrap" Plan Forms
A Wrap Plan is a comprehensive legal document that includes all of the required content under ERISA for various employee benefit welfare plans sponsored by an employer. There are two main reasons to adopt a Wrap Plan. First, a company can file a single Form 5500 instead of multiple Form 5500s. Second, having a Wrap Plan will clean up any potential ERISA plan document compliance issues.
The Form 5500 filing requirement for welfare plans applies to employers with 100 or more employees. Filing one Form 5500 greatly reduces administrative time and costs. It is much easier to fill out one Form 5500 with comprehensive participant and financial data and simply attach various Schedules A for each insured benefit. An employer may also save costs on independent audit fees.
One of the key items the Department of Labor will look for during an audit is compliance with the reporting and disclosure requirements of ERISA. Many employers distribute booklets prepared by insurance companies to inform employees about their medical and other benefit programs. These booklets often do not include all of the legally required language mandated by ERISA and HIPAA, such as detailed claims procedures, privacy rights, plan sponsor information, and ERISA rights provisions. A Wrap plan takes care of this problem.
Package Includes: Plan Document, Summary Plan Description, Adopting Resolutions, and Detailed Instructions.
